Do you need cookie consent for Google Analytics in India and the Gulf?
If Google Analytics runs on your site and your visitors are in India or the Gulf, the law may expect consent. What each market asks, and how to keep useful data when people say no.
If your website uses Google Analytics 4 and has visitors from India or the Gulf, you need a way to give notice about what you collect and to obtain consent where the law requires it. A cookie banner connected to Google Consent Mode is the usual way to do this. The rules differ by country, so the exact wording and settings should be confirmed with your legal counsel.
Why does analytics raise a consent question?
GA4 assigns identifiers to browsers and devices, usually through cookies, and records behaviour such as pages visited and clicks. It also receives IP-derived location data. Whether this counts as personal data depends on the law and the context, and regulators in several regions treat online identifiers as personal data when they can single out an individual.
You do not have to resolve this in theory. The practical question is whether you can show visitors what you collect, why, and let them decide.
What does India's DPDP Act say?
The Digital Personal Data Protection Act, 2023 sets out duties for anyone who decides why and how personal data is processed, called a data fiduciary. Section 5 requires a notice to the person before or when asking for consent, telling them what data is collected and for what purpose. Section 6 requires consent to be free, specific, informed, unconditional and unambiguous, with a clear affirmative action, and says it must be as easy to withdraw as to give.
The Act and the rules under it do not prescribe a cookie banner. They set standards for notice and consent. How they apply to analytics cookies is a legal interpretation, and rules and guidance are still developing, so check current text and ask counsel. We implement what your counsel advises.
What about the UAE, Saudi Arabia and other Gulf markets?
The UAE has Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, and the free zones of DIFC and ADGM have their own data protection laws. Saudi Arabia has its Personal Data Protection Law with implementing regulations. Qatar, Bahrain and others have their own laws. They generally require a lawful basis, transparency and respect for individual rights, and consent is one of the bases.
If you target customers in a specific Gulf country, ask counsel which law applies and what it expects for analytics. Do not assume the rules match India's.
What if visitors come from Europe or the UK?
If people in the European Economic Area or UK visit your site, their laws, including the GDPR and the ePrivacy rules, can apply. Those rules are stricter on analytics cookies. Google also requires Consent Mode v2 signals for certain advertising features for these users. If you run ads that target Europe, implement it properly. Many businesses apply one consent set-up to all visitors, because it is simpler to maintain.
What is Google Consent Mode and how does it work?
Consent Mode is a way for your site to tell Google tags the visitor's consent state. There are several signals, including analytics storage, ad storage, ad user data and ad personalization. Set the default to denied for visitors in regions where consent is required, then update the state when the visitor chooses.
When analytics storage is denied, GA4 does not set analytics cookies. Depending on your settings, it may send cookieless pings, which Google uses for modelling. Check the current documentation for how this behaves, since it has been updated several times. Whatever you configure, your privacy notice should describe it accurately.
What does a good consent banner do?
Good banners are plain and fair.
- They say what is collected and why, in simple words, not legal text.
- They offer Accept and Decline with equal prominence.
- They separate essential cookies from analytics and advertising.
- They load before the analytics tags do, so nothing fires early.
- They remember the choice and offer a way to change it, such as a link in the footer.
- They link to the privacy notice and give contact details for questions.
- They do not use dark patterns such as a bright Accept button and a hidden Decline.
Check that the banner works on a phone, since a banner that covers the page loses visitors. It should not cause layout shifts either; see how to pass Core Web Vitals.
How should you set up GA4 so it respects the choice?
- Add a consent management tool or build a lightweight banner.
- Set Consent Mode defaults before any tag loads.
- Load GA4 and Tag Manager only after consent where your policy requires it, or load them with denied defaults.
- Pass the visitor's choice to Google when it changes.
- Test with Tag Assistant and browser tools to confirm no analytics cookies are set before consent.
- Keep a record of the banner version and wording, and when it changed.
- Review the set-up after any change to tags, plugins or the privacy notice.
Never send names, emails or phone numbers in event data. Google's terms prohibit passing personally identifiable information to Analytics. For the events to track once the set-up is right, read GA4 events every service business should track.
What happens to the data you lose?
Some visitors will decline, so your numbers will undercount. That is normal and acceptable. Treat the data as a sample of behaviour rather than an exact count, and compare leads in GA4 with leads in your CRM. Server-side tagging and modelled data can narrow the gap in some set-ups, though they do not remove the need for consent where it applies.
Who does what?
We implement the technical side, from consent banners and Consent Mode to tag set-up and testing. Your counsel advises on legal interpretation, including which laws apply and what wording to use. Questions
Is a cookie banner legally required in India?
The Digital Personal Data Protection Act, 2023 does not mention cookie banners as such. It requires notice and consent for processing personal data, and analytics identifiers can fall within that depending on how they are used. Many businesses use a banner as the practical way to meet this. Ask your counsel to confirm how it applies to you.
What is Google Consent Mode?
Consent Mode lets your site tell Google tags whether a visitor agreed to analytics or advertising storage, so tags adjust their behaviour. Google requires Consent Mode v2 signals for personalised advertising features for users in the European Economic Area and UK, and many sites implement it everywhere for consistency.
Can I run analytics without any consent?
Some privacy-focused tools use no cookies or personal identifiers and may need no banner. GA4 uses identifiers by default, so it needs a considered set-up. Whether a banner is required depends on the law that applies to your visitors.
What should the banner say?
It should state in plain language what you collect and why, offer accept and decline with equal prominence, link to your privacy notice, and let people change their choice later.
Do I need this if my customers are only in India?
Yes, you still need notice and consent practices for personal data under Indian law. If visitors from the EU or UK reach your site, their laws can apply too.
